The terms that govern your use of the Malvorah Growth OS platform.
By accessing or using the Malvorah Growth OS platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform. These Terms form a legally binding agreement between you ("User", "you") and Malvorah Limited, a company registered in England and Wales ("Malvorah", "we", "us").
If you are accepting these Terms on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that entity, in which case "you" refers to that entity.

The Free Diagnostic is provided at no charge. You acknowledge that:
All prices are displayed in pounds sterling (GBP) and are exclusive of VAT unless stated. VAT will be charged at the prevailing UK rate (currently 20%) where applicable. Malvorah reserves the right to change pricing with 30 days' notice to existing subscribers.
Payments are processed securely by Stripe, Inc. By providing payment details, you authorise Malvorah to charge the applicable fees. Malvorah does not store your card details.
Monthly subscription services (e.g. Scale Partner) require a minimum commitment period as stated at purchase. After the minimum period, subscriptions continue on a rolling monthly basis and may be cancelled with 30 days' written notice to contactus@malvorah.com.
One-time Paid Deliverables: If you are not satisfied with your report, contact us within 14 days of delivery at contactus@malvorah.com and we will work to resolve the issue or provide a full refund at our discretion. This does not affect your statutory rights under the Consumer Rights Act 2015.
Subscription Services: Fees paid for completed monthly periods are non-refundable. We will refund any prepaid fees for future periods on cancellation.
All content on the Platform, including text, graphics, logos, frameworks, and the platform software, is owned by or licensed to Malvorah Limited and is protected by copyright, trade mark, and other intellectual property laws. You may not reproduce, redistribute, or create derivative works from our content without our express written consent.
You retain ownership of all data and content you submit through the Platform. By submitting content, you grant Malvorah a non-exclusive, royalty-free licence to use, store, and process that content solely for the purpose of providing the services to you.
Upon full payment, Malvorah grants you a non-exclusive, non-transferable licence to use the diagnostic reports and deliverables we produce for you for your own internal business purposes. You may not resell, sublicense, or commercially exploit our reports.
You agree not to use the Platform to:
The Platform provides informational and strategic guidance only. Nothing on the Platform constitutes legal, financial, tax, regulatory, or investment advice. You should seek independent professional advice before making significant business decisions.
Diagnostic reports are generated using artificial intelligence. While we take care to ensure quality, AI outputs may contain errors, omissions, or inaccuracies. Malvorah does not warrant the completeness, accuracy, or fitness for purpose of AI-generated content.
To the maximum extent permitted by law, Malvorah's total liability to you for any claim arising out of or in connection with these Terms or the Platform shall not exceed the greater of: (a) the total fees paid by you to Malvorah in the 12 months prior to the claim, or (b) £500.
Malvorah shall not be liable for any indirect, consequential, incidental, special, or punitive damages, including but not limited to loss of profits, revenue, business, data, or goodwill, even if advised of the possibility of such damages.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.
You agree to indemnify, defend, and hold harmless Malvorah Limited, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Platform, your breach of these Terms, or your violation of any applicable law.
The Platform integrates with third-party services including Stripe (payments) and Anthropic (AI processing). Use of such services is subject to their respective terms and privacy policies. Malvorah is not responsible for the acts or omissions of any third-party service provider.
We may modify, suspend, or discontinue any aspect of the Platform at any time. We will provide reasonable advance notice of material changes that affect paid subscribers. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Platform.
We may terminate or suspend your access to the Platform immediately, without prior notice, if you breach these Terms or if we have reasonable grounds to suspect fraudulent, illegal, or harmful activity. You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately.
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute.
Before initiating legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at contactus@malvorah.com. We will endeavour to respond within 10 business days.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Malvorah regarding the Platform and supersede all prior understandings, representations, or agreements.
